Terms of Service

1. Overview
Thermly ("we", "us", "our") provides an intelligent AI request routing API service (the "Service"). By accessing or using the Service, you ("you", "your", "Customer") agree to these Terms of Service ("Terms").
If you do not agree to these Terms, do not use the Service.
2. What the Service Does
Thermly acts as an API proxy that sits between your application and third-party AI model providers (including OpenAI, Anthropic, and Google). The Service:
- Receives API requests in OpenAI-compatible format
- Analyzes the complexity of each request
- Routes the request to the most cost-effective AI model that can handle it
- Returns the AI model's response to your application
- Caches responses to reduce costs on repeated similar queries
- Tracks usage for billing purposes
We do not generate AI responses ourselves. All AI responses are generated by third-party providers. We are a routing and optimization layer.
3. Account and API Keys
- You must create an account to use the Service.
- You are responsible for keeping your API keys secure. Do not share them or embed them in client-side code.
- You are responsible for all activity under your account and API keys.
- If you believe your API key has been compromised, revoke it immediately via the dashboard and generate a new one.
- We may suspend or terminate accounts that violate these Terms or exhibit abusive behavior.
4. Billing and Credits
- The Service uses a prepaid credit system. You purchase credits before using the API.
- Credits are deducted per request based on the actual model used and tokens consumed, plus a markup.
- Cached responses (cache hits) cost $0 and do not deduct credits.
- New accounts receive a promotional credit for evaluation purposes. This may be changed or removed at any time.
- When your credit balance reaches $0, API requests will be rejected until credits are added.
- Credits are non-refundable except at our sole discretion.
- We reserve the right to change pricing with 30 days' notice. Existing purchased credits will be honored at their original value.
- Payments are processed by Stripe. We do not store your credit card information.
5. Acceptable Use
You agree NOT to:
- Use the Service for any illegal purpose
- Attempt to circumvent rate limits, billing, or security measures
- Reverse engineer, decompile, or attempt to extract the source code of the Service
- Use the Service to generate content that violates the terms of the underlying AI providers
- Resell or redistribute access to the Service without our written permission
- Send requests designed to abuse, overload, or disrupt the Service
- Attempt to access other users' data or accounts
6. Data Handling
We take data handling seriously. For complete details, see our Privacy Policy.
In summary:
- We do NOT store your prompts or messages. We only store cryptographic hashes for caching purposes.
- We store usage metadata: token counts, model used, cost, and timestamps.
- Your prompts are forwarded to third-party AI providers (OpenAI, Anthropic, Google) for processing. Their privacy policies apply to that data.
- Cached responses are stored temporarily (1-24 hours) and automatically deleted.
7. Third-Party AI Providers
The Service routes requests to third-party AI model providers. By using the Service, you acknowledge that:
- Your request content is sent to these providers for processing
- These providers have their own terms of service and privacy policies
- We do not control how these providers process or store your data
- Model availability, quality, and capabilities are determined by the providers
Current providers include: OpenAI, Anthropic (Claude), and Google (Gemini).
8. Service Availability
- We strive to maintain high availability but do not guarantee 100% uptime.
- The Service depends on third-party providers. If they experience outages, the Service may be affected.
- We implement fallback chains: if one provider is unavailable, requests are automatically routed to alternative providers.
- We reserve the right to perform maintenance with reasonable notice.
- We are not liable for damages caused by service interruptions.
9. Limitation of Liability
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
- We are not responsible for the accuracy, quality, or appropriateness of AI-generated responses.
- We are not liable for any decisions made based on AI-generated content.
- Our total liability to you shall not exceed the amount you have paid us in the 12 months preceding the claim.
- We are not liable for indirect, incidental, special, consequential, or punitive damages.
10. Account Termination
- You may close your account at any time by contacting us.
- We may suspend or terminate your account for violation of these Terms, non-payment, or abusive behavior.
- Upon termination, your remaining credits are forfeited unless we agree otherwise.
- We will delete your account data within 30 days of termination, except where retention is required by law or for billing records.
11. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by email or through the dashboard at least 30 days before they take effect. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
